Owned by: Cynthia Feldman, (hereafter SIRE OWNER) during the 2011 breeding season.
In consideration for this breeding, OWNER/AGENT agrees to pay the stud fee of which includes a $100.00 booking fee.
OWNER/AGENT agrees to any additional charges involved as specified below.
I understand that I must return one signed and dated copy of this contract and the booking fee and any other documentation required to initiate this contract.
1) SIRE OWNER agrees to ship viable semen to mare owners authorized representative during each heat period, during breeding season until either mare has conceived or that said mare is open and that OWNER/AGENT wishes to wait until the next breeding season.
2) Should said mare fail to conceive the first season substitutuion of a second mare in her place shall be the sole discretion of SIRE OWNER. There is a $100.00 substitution fee.
3) SIRE OWNER agrees that if above mare not have a live foal, that can stand and nurse, the stud fee will be carried forward to the next breeding season. The stud fee shall only be carried forward one season, however: thereafter this contract shall be deemed fulfilled even if said mare still fials to conceive or deliver a live foal the subsequent season. Should the usual stud fee charged by SIRE OWNER change between first and second season of this contract, OWNER/AGENT shall NOT be responsible for tht difference. Once a live foal has been delivered, whether unassisted or assisted by any method, and said foal can stand and nurse unassisted, this contract has be fulfilled by SIRE OWNER.
a) The stud fee will be carried forward, and the live-foal guarantee is valid, only if OWNER/AGENT has properly maintained the health of the mare, including but not limited to appropriate vaccination against Rhinopneumonitis.
4) It is further agreed that if either the sire or mare dies, or becomes unfit for service prior to breeding the mare, then the stud fee (or booking fee) shall be refunded within 30 days, and this contract shall than become null and void. In the case that the sire dies, or becomes unfit for service during the life of the contract after the first breeding than the contract will be deemed fulfilled if mare becomes pregnant. If said mare is not pregnant a refund will be given, upon receipt of Veterinarian Certification stating mare is open, within 30 days. The live foal guarantee will no longer be applicable.
5) OWNER/AGENT agrees to pay all costs of collection and shipment of semen. Arrangements should be made directly with agent providing this service for payment(**). In the event that said agent is unavailable when needed, the SIRE OWNER will not be held liable for any cost incurred by OWNER/AGENT. SIRE OWNER will attempt to locate another qualified indiviudal to provide said service but can not be held responsible for failure to ship semen due to any other person or agency.
6) It is the OWNER/AGENTS responsibility to inquire with whatever registry(s) may be utilized in registering any foal(s) resulting from the execution of this contract.
a) SIRE OWNER agrees to provide registration certification as follows: (circle one)

Signed registration application to the Arabian Horse Assosciation and Shipped Semen breeding certificate. (Mare owner to pay fee for shipped semen certificate).
OR
NON-PUREBRED
Signed registration application to the Arabian Horse Assosciation Half Arabian Registry.
7) HEALTH: ALL ARABIAN OR PART ARABIAN MARES MUST HAVE A CLEAR SCID TEST. A copy of test results to be submitted with this contract.
8) TERMS: Signed and dated contract, booking fee, copy of registration papers (if applicable) and copy of scid test must be returned to SIRE OWNER for approval and to initiate this contract.
b) Balance of stud fee must be paid PRIOR to any shipment of semen.
c) SIRE OWNER will send copy of signed contract to OWNER/AGENT after receipt of above and upon approval.
d) SIRE OWNER reserves the right to refuse acceptance of contract for any reason.
9) LEGAL: OWNER/AGENT signing this contract assumes all responsibility for fees due. SIRE OWNER cannot become involved in disputes regarding leased mares.
b) Should any legal actions be required to force compliance with this contact they must be filed in Amador County, California.
